Terms and Conditions

Welcome to The Green Academy Australia, Green Academy Pty. Ltd. (Australian Business Number 92667109337). Upon enrolling in a course with The Green Academy, you (“the Student”) are entering a legal agreement under common law, in which you agree to abide by these Terms & Conditions (including meeting stated payments), in exchange for the service offered by The Green Academy during the course of enrolment.

The  Terms & Conditions are subject to the jurisdiction of the laws of Queensland, Australia. These  Terms & Conditions form the agreement between The Green Academy and the Student. It is the Student’s responsibility to fully read, understand and agree to all Enrolment Terms & Conditions, Privacy Statement and Fees & Charges upon enrolment. By agreeing to these Terms and Conditions and the Privacy Statement on the enrolment form, the Student confirms they have read, understood and agreed with the Terms and Conditions.

Terms and Conditions

− Students will be assessed by The Green Academy during the progress of their course, and they agree to accept the decision of The Green Academy regarding their placement and assessment.

− The Green Academy has a legal duty to check the correctness of visa details and may need to notify any changes to the Australian Government upon the arrival and during the course.

− Students’ class attendance must be not less than 80%.  If students hold an Australian Student Visa, The Green Academy is obligated by law to report to the Department of Immigration and Border Protection if their attendance falls below 80% or if their performance is consistently unsatisfactory.

− Holidays will only be granted if students can provide a medical certificate or inform The Green Academy prior to commencing their studies.

− Students cannot transfer to another school or college during the enrolled course period without obtaining a written letter of release from The Green Academy.

− A full week’s tuition fee is payable for weeks that may include a public holiday, and no classes will be held on public holidays.

− If students are on a Student visa, they must notify The Green Academy within seven (7) days of any change of address, and The Green Academy will inform the Department of Immigration and Border Protection about the address change.

− The Green Academy, its representatives, and staff will not be held liable for any loss, damages, death, illness, or injuries to people or property that occur during activities or excursions organized by The Green Academy. Students are solely responsible for obtaining comprehensive travel, accident, and medical insurance in their own country.

− The Green Academy is required to share personal information about its students with the Australian Government and other designated authorities.

− Students agree to pay course fees due at least four (4) weeks prior to the course start date. They understand that overdue fees may result in exclusion from classes and possible reporting to the Department of Immigration and Border Protection.

Refund & Cancellation Policy

− Requests for refunds must be made in writing to the Director, The Green Academy, GPO Box 2800, Brisbane QLD 4000.

− Tuition fees are not transferable to other institutions or other students once you commence your enrolment.

− The administration fee, material fee, and government tax are non-refundable.

− All refunds will be paid to the person who has entered into the contract with The Green Academy, unless the person gives a written direction to pay the refund to someone else.

− Refunds will be processed and paid within four (4) weeks of the receipt of the written notification.

− Bank charges are deducted from refunds.

− If the required visa is not granted, a full refund of tuition fees is made, provided that sufficient evidence of visa refusal is provided by The Department Of Immigration and Border Protection.

− If written cancellation of the enrolment is received four (4) or more weeks prior to the initial course commencement – 100% of tuition fees will be refunded.

− If written cancellation of the enrolment is received less than four (4) weeks prior to the initial course commencement – 50% of tuition fees will be refunded.

− In the unlikely event of The Green Academy being unable to provide a course for an enrolled student, all fees will be refunded in full.

− No refunds will be granted once the student commences studies at The Green Academy unless the student has a legitimate complaint against The Green Academy that can be substantiated under the Consumer Protection Laws of the Commonwealth of Australia or the State of Queensland.

− Refunds will not be granted if the Department of Immigration and Border Protection excludes you from continuing your studies, you withdraw from studies after the program begins, or you are expelled.

− Should a student become seriously ill or be required to return home due to exceptional circumstances of a compassionate nature (such as death or severe illness of the immediate family) and can no longer continue their study, The Green Academy may refund the balance of unused tuition fees.

− Exceptional fee refunds are wholly at the discretion of the Director. Appropriate evidence, such as an original medical certificate or death certificate in English, will be required.

− In the unlikely event that The Green Academy is unable to deliver your course in full, you will be offered a refund of all the course money you have paid to date. The refund will be paid to you within 2 weeks of the day on which the course ceased being provided. 

Alternatively, you may be offered enrolment in an alternative course by The Green Academy at no extra cost to you. You have the right to choose whether you would prefer a full refund of course fees, or to accept a place in another course. If you choose placement in another course, we will ask you to sign a document to indicate that you accept the placement. If The Green Academy is unable to provide a refund or place you in an alternative course TPS (Tuition Protection Services – ESOS) will place you in a suitable alternative course at no extra cost to you. Finally, if TPS cannot place you in a suitable alternative course, the ESOS Assurance Fund Manager will attempt to place you in a suitable alternative course or, if this is not possible, you will be eligible for a refund as calculated by the Fund Manager.

− This written agreement, and the right to make complaints and seek appeals of decisions and action under various processes, does not affect the rights of the student to take action under the Australian Consumer Law if the Australian Consumer Law applies.
